ServerBorn - Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes activities and content that are not permitted on ServerBorn. It is incorporated into our Terms of Service by reference. Violations can result in immediate suspension or termination of your account, with or without refund.

Plain English: Don't break the law, don't break the network, don't break other customers' sites. If your use looks like it might fall in a gray area, ask first.

Section 01Scope

This AUP applies to anyone who accesses or uses any ServerBorn service, including the customer panel, the marketing site, and any site or service hosted on our infrastructure. You are responsible for the conduct of anyone you grant access to your account or services.

Section 02Prohibited Content

You may not host, store, or transmit:

content that is illegal under U.S. federal law, the law of the State of South Carolina, or the law of any jurisdiction in which the content is delivered;
child sexual abuse material (CSAM), or any content sexually exploiting minors, in any form;
content that infringes copyright, trademark, trade secret, or other intellectual property rights;
content that threatens, harasses, or incites violence against any individual or group;
content used to facilitate human trafficking, terrorism, or other serious criminal activity;
malware, viruses, ransomware, exploit kits, phishing kits, or any code designed to compromise other systems;
content designed to defraud, including phishing pages, scareware, fake invoices, and deceptive checkout pages.

Section 03Prohibited Conduct

You may not use the services to:

violate the privacy or publicity rights of any person;
collect or harvest personal information without lawful basis;
impersonate any person or entity in a way that is misleading or unlawful;
engage in unsolicited bulk messaging of any kind;
operate ponzi or pyramid schemes, illegal lotteries, or any business that requires a license you do not hold;
provide hosting, redirection, control, or staging for the activities prohibited above on behalf of others.

Section 04Network and System Abuse

You may not use the services to:

scan, probe, or attempt to gain unauthorized access to any system, network, or account that you do not own or have explicit permission to test;
conduct denial-of-service attacks, reflection or amplification attacks, or otherwise generate traffic intended to disrupt third parties;
circumvent rate limits, security controls, or quotas, including those applied by us, by Cloudflare, or by upstream providers;
operate open relays, open proxies, anonymizing exit nodes, or any service that masks the origin of malicious traffic;
operate cryptocurrency miners, GPU compute farms, or other workloads whose primary purpose is to consume compute or bandwidth disproportionate to a normal hosting workload.

Section 05Email and Messaging

If your plan includes email or you send email from a site on our infrastructure, you must:

send only to recipients who have explicitly opted in and to whom you have a transactional relationship;
use accurate "From," "Reply-To," and routing headers, and never disguise the origin of a message;
honor unsubscribe requests promptly and provide a working unsubscribe mechanism in every commercial message, as required by the CAN-SPAM Act and analogous laws;
maintain SPF, DKIM, and DMARC records on every sending domain;
respond to abuse reports forwarded to you within 24 hours.

We may rate-limit, queue, or refuse to deliver mail at our discretion to protect our deliverability reputation and that of other customers.

Section 06Resource Usage

Each plan includes a set of resources (sites, storage, sustained CPU, RAM, and inbound/outbound bandwidth). Burst usage above plan limits is expected and we do not throttle every spike. However, sustained usage at a level that affects other customers on shared infrastructure may result in:

notice and a request to upgrade to a higher tier or a dedicated configuration;
throttling of the offending workload;
suspension if the workload is causing measurable harm to other customers and you do not act on our notice in a reasonable time.

"Unmetered" bandwidth on a plan is for normal web traffic. It is not a license to serve large-file mirrors, illegitimate redirector traffic, or content delivery for unrelated third parties.

Section 07Enforcement

Where practical, we will provide notice of an AUP issue and a reasonable opportunity to cure. For serious or ongoing abuse, including active phishing, active malware distribution, CSAM, or attacks on third parties, we reserve the right to suspend or terminate the affected account immediately and to preserve evidence for law enforcement. Suspension or termination under this AUP does not entitle you to a refund of any prepaid fees, except as expressly required by our Refund Policy.

Section 08Reporting Abuse
